Permits

Chemical Waste Management’s (CWM) hazardous waste landfill operates under both a Resource Conservation and Recovery Act (RCRA) permit from the State of California (DTSC); and under a Toxic Substances Control Act (TSCA) permit from the U.S. EPA. The TSCA permit is required for the PCB storage and disposal at the facility.

There currently are two separate permitting actions that are being pursued by CWM: an expansion of the facility and a renewal of the permit.

DTSC is reviewing a proposed expansion for the RCRA permit at the CWM Kettleman Hills facility. Only once DTSC has made a final decision on the CWM permit expansion would EPA act on the renewal and modification of the TSCA PCB permit applications.

When a proposed permitting decision on CWM’s applications has been made, EPA will issue a public notice. In addition, EPA will hold a public meeting to announce the proposal and provide the opportunity for a public question and answer workshop, as well as open a 60-day period for the public to formally comment. A formal public hearing will also be held to take comments on the proposed decision.

EPA will ensure the facility is in compliance prior to continuing our permit application review.  The state and EPA will continue to regularly inspect and monitor compliance at the facility and take all information into account as a part of our proposed permit decisions. As with other facilities, EPA will use its legal authorities to address any violations that pose a risk to human health.
