Draft Environmental Justice Assessment
The Draft EJ Assessment was released by EPA in 2007. Its primary purpose was to inform the PCB permitting review process. Specifically, EPA conducted the assessment to help evaluate impacts and potential impacts of the TSCA activities at the KHF on communities of concern, and not to evaluate all potential impacts on and burdens borne by these communities. Moreover, EPA's assessment was necessarily limited by data that was available at the time the assessment was developed, in 2006. Because certain information and conclusions in the Draft 2007 Assessment are out of date and should not be cited, EPA has removed the Assessment from the website. What is the CWM Kettleman Hills Facility?
The Chemical Waste Management (CWM), Kettleman Hills Facility is a commercial hazardous waste treatment, storage, and disposal facility located in Kings County, California, south-west of the intersection of Interstate 5 and Highway 41. The CWM Facility handles polychlorinated biphenyls (PCB) waste, non-PCB hazardous waste, and solid waste.
EPA regulates the handling, storage and disposal of PCB waste at the CWM Facility under a TSCA permit. The State of California, authorized under federal law, regulates the handling, storage and disposal of hazardous waste under a Resource and Recovery Act (RCRA) hazardous waste permit.

CWM has applied to the California Department of Toxic Substances Control (DTSC) for a modification to its Resource Conservation and Recovery Act (RCRA) permit to allow for the expansion of its hazardous waste landfill, Unit B-18, by 14 acres. CWM also applied to EPA to both renew its existing TSCA PCB permit and to modify that same permit to allow for the expansion of the landfill. EPA is responsible for regulating the storage and disposal of PCBs under TSCA, including the decision on whether to renew CWM’s PCB permit and grant the modification request covering the landfill expansion for PCB disposal purposes.
