Regional Haze - Federal Implementation Plans

September 2012: Hawaii Regional Haze – Final Federal Implementation Plan

On September 14, 2012, EPA finalized action on a Regional Haze Federal Implementation Plan (FIP) for Hawaii. The plan is designed to reduce human-caused visibility impairment at the Haleakala National Park and the Hawaii Volcanoes National Park.

May 2012: Hawaii Regional Haze – Proposed Federal Implementation Plan

On May 14, 2012, EPA proposed a Federal Implementation Plan (FIP) to address the requirements for reducing regional haze and improving visibility at Hawaii Volcanoes National Park on the Big Island, and Haleakala National Park on Maui.

Hawaii Infrastructure State Implementation Plans (SIP)

August 2014: Approval and Promulgation of State Implementation Plans; Hawaii; Infrastructure Requirements for the 2008 8-Hour Ozone and the 2010 Nitrogen Dioxide National Ambient Air Quality Standards

On August 5, 2014, EPA approved Hawaii's State Implementation Plan infrastructure submittal for the 2008 Ozone and 2010 Nitrogen Dioxide National Ambient Air Quality Standards. In addition to Hawaii's regulatory requirements, several of the applicable requirements are covered by federal implementation plans, which address Prevention of Significant Deterioration, Reasonably Attributable Visibility Impairment and Regional Haze for the State of Hawaii.

April 2014: Approval and Promulgation of State Implementation Plans; Hawaii; Infrastructure Requirements for the 2008 8-Hour Ozone and the 2010 Nitrogen Dioxide National Ambient Air Quality Standards (NAAQS)

On April 25, 2014, EPA proposed to approve the Hawaii Infrastructure SIP submittal for the 2008 Ozone and 2010 Nitrogen Dioxide NAAQS as meeting the requirements under CAA section 110(a)(2). Although Hawaii's submittal was not complete, the EPA is not issuing findings of failure to submit a SIP addressing section 110(a)(2)(D)(i)(I) of the CAA, due to the D.C. Circuit's recent opinion in EME Homer City Generation v. EPA, 696 F.3d 7, 31 (D.C. Cir. 2012). This opinion concluded that a SIP cannot be deemed to lack a required submission or deemed deficient for failure to meet the 110(a)(2)(D)(i)(I) obligation until after the EPA quantifies that obligation. Other elements that were not complete meet the CAA Section 110(a)(2) requirements because they are being addressed through current federal implementation plans (FIPs) addressing Prevention of Significant Deterioration (PSD), Reasonably Attributable Visibility Impairment (RAVI) and Regional Haze.


March 2014: Approval and Promulgation of the Hawaii Infrastructure State Implementation Plan (SIP) submittal for the 2008 Lead (Pb) National Ambient Air Quality Standard (NAAQS) as meeting the requirements under Clean Air Act (CAA) section 110(a)(2)

On March14, 2014, EPA approved the Hawaii Infrastructure SIP submittal for the 2008 Lead (Pb) NAAQS as meeting the requirements under CAA section 110(a)(2). Elements that were not submitted in this revision are enacted through current federal implementation plans (FIPs) addressing Hawaii's Prevention of Significant Deterioration program, Hawaii's Reasonably Attributable Visibility Impairment requirement and Hawaii's Regional Haze requirement. This action will not require any new FIPs.

September 2013: Proposal for Approval and Promulgation of the Hawaii Infrastructure State Implementation Plan (SIP) submittal for the 2008 Lead (Pb) National Ambient Air Quality Standard (NAAQS) as meeting the requirements under Clean Air Act (CAA) section 110(a)(2)

On September 25, 2013, EPA proposed to approve the Hawaii Infrastructure SIP submittal for the 2008 Lead (Pb) NAAQS as meeting the requirements under CAA section 110(a)(2). Elements that were not submitted in this revision are enacted through current federal implementation plans (FIPs) addressing Hawaii's Prevention of Significant Deterioration program, Hawaii's Reasonably Attributable Visibility Impairment requirement and Hawaii's Regional Haze requirement. This action will not require any new FIPs.


July 2012: Final Action to Partially Approve/Partially Disapprove and Promulgate the Hawaii Infrastructure State Implementation Plan (SIP) submittal for the 1997 8-hour ozone, 1997 fine particulate (PM2.5) and 2006 PM2.5 National Ambient Air Quality Standards (NAAQS) as meeting the requirements under Clean Air Act (CAA) section 110(a)(2)

On July 26, 2012, EPA took final action to partially approve and partially disapprove the Hawaii Infrastructure SIP submittal for the 1997 8-hour ozone, 1997 PM2.5 and 2006 PM2.5 NAAQS as meeting the requirements under CAA section 110(a)(2). Elements that are not approvable are enacted through two current federal implementation plans (FIPs) addressing Hawaii's Prevention of Significant Deterioration program and Hawaii's Reasonably Attributable Visibility Impairment requirement, as well as a new FIP to address Hawaii's Regional Haze requirement. The Hawaii Regional Haze FIP is being addressed in a separate action with a consent decree deadline for final action by September 15, 2012. The partial disapproval will not require any new FIPs. We are under a settlement agreement deadline to take final action on the Hawaii 1997 8-hour ozone infrastructure SIP by July 31, 2012.

Elements that are not approvable are enacted through two current federal implementation plans (FIPs) addressing Hawaii's Prevention of Significant Deterioration program and Hawaii's Reasonably Attributable Visibility Impairment requirement, as well as a new FIP to address Hawaii's Regional Haze requirement. The Hawaii Regional Haze FIP is being addressed in a separate action with a consent decree deadline for final action by September 15, 2012. The partial disapproval will not require any new FIPs.
