GHG PSD Permitting in EPA's South Central Region

On November 10, 2014, EPA published in the Federal Register our final SIP and FIP GHG actions as follows: 1. The final action to rescind a majority of the Federal Implementation Plan (FIP) for Texas for greenhouse gas (GHG) Prevention of Significant Deterioration (PSD) permitting, titled “Approval and Promulgation of Air Quality Implementation Plans; Withdrawal of Federal Implementation Plan; Texas; Prevention of Significant Deterioration; Greenhouse Gas Tailoring Rule Revisions;” and 2. The final approval of the majority of the revisions to the Texas State Implementation Plan (SIP) submitted by the Texas Commission on Environmental Quality (TCEQ), titled “Approval and Promulgation of Air Quality Implementation Plans; Texas; Prevention of Significant Deterioration; Greenhouse Gas Tailoring Rule Revisions.”

The U.S. Supreme Court Decision in Utility Air Regulatory Group v. Environmental Protection Agency, 134 S. Ct. 2427 (2014) held that EPA may not treat GHGs as an air pollutant for purposes of determining whether a source is a major source required to obtain a PSD or Title V permit and thus invalidated regulations inplementing that approach.  EPA issued a direct final rule to narrowly amend the permit rescission provisions in the federal PSD regulations and the rulemaking became effective on July 6, 2015.
