Off-Site Waste and Recovery Operations (OSWRO): National Emission Standards for Hazardous Air Pollutants (NESHAP)

Rule Summary

The 2015 final rule implements the Clean Air Act (CAA) section 112(d) to control hazardous air pollutants (HAP) emissions at major sources that receive certain wastes, used oil, and used solvents from off-site locations for storage, treatment, recovery, or disposal.

Off-Site Waste and Recovery Operations (OSWRO) facilities subject to the final rule are required to control emissions of organic HAP by meeting emissions limitations and work practice standards reflecting the application of maximum achievable control technology (MACT) and amendments made as a result of the risk and technology review (RTR). The final rule applies to OSWRO affected sources which includes tanks, surface impoundments, containers, oil- water separators, individual drain systems and other material conveyance systems, process vents, and equipment leaks.

In May 2015 the EPA was petitioned for reconsideration of certain aspects of the final rule by Eastman Chemical Company and the American Chemistry Council. The EPA granted reconsideration of the issue related to pressure relief devices on February 8, 2016, and denied reconsideration of the issue related to leak detection and repair (LDAR) connector monitoring requirements. The denial was published in the Federal Register on May 16, 2016 (81 FR 30182).
