Summary
The U.S. Environmental Protection Agency, Region 5, is providing this notice that it has filed a proposed Consent Agreement and Final Order (CAFO) against Ingredion Incorporated (Respondent) for violations of the Clean Water Act (CWA). This CAFO will settle EPA's allegations that Respondent violated the CWA at the facility by failing to have a Facility Response Plan (FRP), and failing to address within the facility's Spill Prevention, Countermeasure, and Control Plan (SPCC) its compliance with several requirements under 40 C.F.R. Part 112 to prevent and minimize the effects from oil spills at the facility.
In the proposed CAFO, EPA and Respondent have agreed that Respondent will pay a civil penalty of $99,500 and complete a Supplemental Environmental Project costing at least $62,590 to resolve the alleged CW A violations. The Respondent has also brought its FRP and SPCC plans into compliance.
