Executive Order (E.O.) 13211 - Actions Concerning Regulations That Significantly Affect Energy Supply, Distribution, or Use - was issued by President George W. Bush in 2001. It applies to any significant energy action as defined by the E.O. A significant energy action is one that promulgates, or is expected to lead to the promulgation of, a final rule that is:

• a significant regulatory action under E.O. 12866 and
• likely to have a significant adverse effect on the supply, distribution or use of energy or is designated by the Administrator of OMB/OIRA as a significant energy action.

For significant energy actions, the federal agency must prepare a Statement of Energy Effects and submit the Statement to the Office of Information and Regulatory Affairs (OIRA) in the Office of Management and Budget (OMB). The Statement, or a summary, must be included in the proposed and final rulemaking notices published by the agency. A Statement of Energy Effects includes information on any adverse effects on energy supply, distribution, or use, and reasonable alternatives to the action along with the expected effects of such alternatives on energy supply, distribution, or use.
