Summary

EPA is seeking public comments on a proposed settlement agreement with OXY USA, Inc. EPA will  not make a final decision on whether to enter the agreement until after considering public comments on the potential agreement.

Oil has been seeping from a property located to the southwest of the Gary Airport, into a drainage ditch running along Cline Ave. The property was used for storage and disposal by City Services. U.S. EPA has been using booms to capture and contain the oil in the ditch.

OXY USA, Inc. has signed a proposed settlement agreement in which it will take over the booming and collection operations and conduct an investigation to evaluate options for a permanent approach to contain oil and other materials at the site to stop releases to the ditch and beyond. EPA will oversee and approve the work to be done by OXY USA, Inc., and will select a proposed final cleanup approach for public review and comment.
