National Term on Suspension and Debarment

This term and condition applies to all recipients of EPA nonprocurement transactions.


All recipients

Recipients shall fully comply with Subpart C of 2 CFR Part 180 entitled, “Responsibilities of Participants Regarding Transactions Doing Business With Other Persons,” as implemented and supplemented by 2 CFR Part 1532.   Recipient is responsible for ensuring that any lower tier covered transaction, as described in Subpart B of 2 CFR Part 180, entitled “Covered Transactions,” includes a term or condition requiring compliance with Subpart C.  Recipient is responsible for further requiring the inclusion of a similar term or condition in any subsequent lower tier covered transactions.  Recipient acknowledges that failing to disclose the information required under 2 CFR 180.335 may result in the delay or negation of this assistance agreement, or pursuance of legal remedies, including suspension and debarment.

Recipients may access suspension and debarment information at the System for Award Management (SAM). This system allows recipients to perform searches determining whether an entity or individual is excluded from receiving Federal assistance.  This term and condition supersedes EPA Form 5700-49, “Certification Regarding Debarment, Suspension, and Other Responsibility Matters.”

Information for EPA grants personnel


EPA grants personnel awarding EPA assistance agreements have related responsibilities.

  • Familiarize yourself with Subpart D of 2 CFR Part 180, entitled Responsibilities of Federal Agency Officials Regarding Transactions and Subpart D of 2 CFR Part 1532, EPA’s Nonprocurement Debarment and Suspension regulations. You must comply with these regulations.
  • Check the System for Award Management (SAM) before awarding initial and supplemental funding packages. See Subpart D to determine the manner in which you must handle excluded or disqualified person(s).
  • Review the information that participants* provide in response to 2 CFR 180.335, which requires participants to provide certain information before entering into a covered transaction with EPA.
  • Attach the Suspension and Debarment National term and condition to all, supplemental, and incremental funding packages. See IGMS Administrative Database, under National Conditions.

* Pursuant to 2 CFR 180.980, participant means any person who submits a proposal for or who enters into a covered transaction, including an agent or representative of a participant.
