Subpart M – Food Processing

Rule Information

EPA has made a final decision not to include food processing as a distinct Subpart in 40 CFR Part 98 because the proposal for this Subpart did not include any unique requirements for monitoring or reporting of process emissions. Food processing facilities are still required to report emissions under other Subparts of the Greenhouse Gas Reporting Program if they meet the reporting threshold of 25,000 metric tons of CO2 equivalent per year for all covered emissions sources covered in the GHG reporting program (40 CFR Part 98). Applicable Subparts are likely to include Subpart C (stationary combustion), Subpart HH (municipal solid waste landfills), and Subpart II (wastewater treatment).
