E-Plan
Alabama now accepts submittals via E-Plan at https://ERplan.netExit. There is a fee associated with this service. Submitted information is retained from year to year in one database and changes are easily made by logging in. If you have previously submitted Tier II data by e-mail, your facility information should already be in E-Plan. However, you still must register for an account with E-Plan. Tier2 Submit
Tier2 Submit can be used to submit data electronically with no cost. A new version of Tier2 Submit is available around November of each year. The Tier II File must pass verification and the file exported must be in a .t2s format. Send the exported .t2s file to al312@adem.alabama.gov with the following information in the subject line: the filing year, facility name and facility Master ID Number. If you have questions about your submission contact either email address listed in the contacts above.

Whether you submit via E-Plan or Tier2Submit you will be asked to input a Master ID Number in the State Required Field. If your facility has or ever had a permit issued by ADEM, use eFile on the ADEM’s website to determine your Master ID. ADEM is diligently working to issue a master ID to all facilities who have previously filed their Tier II information. This Master ID Number is location-specific. If you are unsure if you have an existing Master ID Number, please contact Beth Woodfin (beth.woodfin@adem.alabama.gov), 334-260-2700 to verify your Master ID number. This number will remain the same year-to-year.

Special Instructions: Colorado requires that Tier II reports be filed using EPA’s Tier2 Submit software. Tier2 Submit files must be submitted electronically via email. All Tier2 reports must pass validation prior to submittal or they will be rejected. To create a validated submission of your Tier II report you must use “Create Submission” in the File menu. Colorado will not accept exported Tier II reports. Download the latest version of Tier2 Submit.
Colorado has instituted a single-point submission process for Tier II reporting. Beginning in reporting year 2015, facility owners/operators are required to submit their Tier II report(s) to the Colorado Department of Public Health and Environment. Facilities are not required to provide the same report to the local emergency planning committee (LEPC) or the local fire department unless those agencies maintain local reporting requirements. Please check with your LEPC and fire department to determine if they require direct Tier II reporting to their agency. Tier II data submitted to the state will be distributed to the LEPCs and local fire departments.
Colorado has instituted several state-specific changes for the 2015 Tier2Submit. They can be found under the “State Field” tab in Tier2 Submit. Please see Colorado’s Tier II webpage for instructions.

Special Instructions: The Connecticut Department of Energy and Environmental Protection (DEEP) is tasked by state statute (22a-602) to manage EPCRA data for the Connecticut State Emergency Response Commission (SERC). DEEP prefers that each facility use EPA's Tier2 Submit software application for the current reporting year. DEEP will accept Tier2 Submit electronic file submissions via email attachment to dep.ctepcra@ct.gov, or submissions on cd with one zipfile submission to SERC address with a company cover letter and label on the CD, or paper through regular mail. DEEP will reply in kind to submissions (of Tier2 Submit electronic files only) made by email with an acknowledgment of receipt only, if one is requested. Email acknowledgment does not constitute validity of the data and a follow-up notification will be made to the facility if DEEP encounters problems with data. On September 17, 2013, the Commonwealth Emergency Response Commission (CERC) Board of Commissioners met and unanimously passed Policy 003-2013. Beginning January 1, 2014, all facilities within the Commonwealth of Kentucky, subject to Emergency Planning and Community Right-To-Know Act (EPCRA) sections 311-312, are required to file Tier2 reports and pay all associated fees electronically in accordance with KYEM's annually published "EPCRA - How to Comply Packet." Furthermore, those facilities that submit paper documents, either reporting forms or payments, shall have those documents marked "Return to Sender" and classified as non-compliant. If a facility remains non-compliant, they shall be subject to the maximum penalty allowable, as stated in KRS 39E.990.
KYEM annually updates the "EPCRA - How to Comply Packet," which includes step-by-step instructions required to be compliant with Kentucky and EPCRA regulations. This document will be available for download on the KYEM website listed above prior to the start of the reporting period, January 1st.
EPCRA allows the exact location of hazardous substances at a facility to be kept confidential. Facilities wishing to keep this information confidential must submit a hard copy of the Tier2 Confidentiality Form.

Special Instructions: As of September 1st, 2014, the State of Tennessee requires all facilities operating in Tennessee to electronically file Tier II reports using E-Plan.
Facilities are required to provide Tier II information to the following entities:
- SERC. Electronic submission of the Tier II report with E-Plan. A paper copy is not required.
- LEPC in the county the facility is located. Contact the appropriate LEPC to confirm whether they require a paper copy of the Tier II report. A paper copy of the electronic submission can be printed from E-Plan and supplied to the LEPC.
- Local fire department in the county the facility is located. Contact the appropriate fire department to confirm whether they require a copy of the Tier II report. A paper copy of the electronic submission can be printed from E-Plan and supplied to the fire department.
E-Plan charges $25.00 per facility to submit a Tier II report. The charge is paid directly to E-Plan. The state has no additional charges. Tier II reports are due by March 1st of each year.

The TXT2 Number must appear on the Tier2 Submit State Fields screen, the check or money order for the fee payment, and in the email subject line. Fee payments must be sent by U.S. Mail to the address provided on the Filing Fee Payment Form. Note: Submission of your electronic data file to TCEQ Tier II Chemical Reporting Program serves as notification to the State Emergency Response Commission (SERC) for Tier II data. Special Instructions: The Utah Department of Environmental Quality (UDEQ) is tasked by state statute to manage EPCRA data for the Utah State Emergency Response Commission (SERC). UDEQ prefers that each facility use EPA's Tier 2 Submit software for the current reporting year. UDEQ will accept Tier2 Submit electronic file submissions via direct internet form submission at https://tier2.deq.utah.gov/Exit. UDEQ will reply to submissions (of Tier2 Submit electronic files only) made by email with an acknowledgment of receipt only. Email acknowledgment does not constitute validity of the data; a follow up notification will be made to the facility if UDEQ encounters problems with data. Special Instructions: The Washington State Department of Ecology manages EPCRA reports and tracks businesses compliance on behalf of the Washington SERC. All EPCRA reports should be submitted to the address above. Please note the Washington SERC offers a state form at the website above. The SERC requires actual maximum and average pounds stored. Also, remember to include to the Washington Community Right-to-Know number on all reports.
We ask Tier Two reporters to use our online reporting application, Tier Two Online Exit. Tier Two Online offers a quick, efficient method of reporting. It allows reporters to access previously submitted data, to immediately submit reports to the SERC upon completion, and print completed forms for their records and for submittal to local agencies. Does Washington accept Tier2 Submit? Unfortunately, we are not able to accept Tier2 Submit.
For 311 submissions, the SERC prefers a Material Safety Data Sheet (MSDS) List in lieu of copies of each MSDS. This form is available on the website listed above. Check with your Local Emergency Planning Committee Exit (LEPC) for their requirements.
