Model: CERCLA Section 106 UAO for RD/RA

Interim final model unilateral administrative orders (UAO) for remedial design and remedial action (RD/RA) under section 106 of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund).  One purpose of this model order is to improve the quality of remedial actions performed by private parties.  OSWER Dir. No. 9833.0-2(b). Issued 3/30/1990.

The RD/RA UAO model was supplemented in August 2001 for sections addressing work to be performed (section IX) and quality assurance, sampling, and data analysis (section XVI). The 2001 revisions are available below in PDF.

The model document should be used in conjunction with EPA's 3/7/1990 guidance on CERCLA 106(a) UAOs for RD/RA.

On September 30, 2015, the Agency issued a revised model RD/RA UAO and new companion Statement of Work (SOW). The 2015 revised model RD/RA UAO supersedes the 1990 version of the model. The revised model RD/RA UAO is available from the Agency’s Cleanup Enforcement Model Language and Sample Documents Database.
